Narmada Conservation Initiative has recently published book titled, "Paani ke Liye Van Prabandh" (Managing Forests for Water). Authored by Sri Pankaj Srivastava, the winner of Govt. of India's prestigious Medini Award for his book "Jungle Rahe Taki Narmada Bahe", this is yet another very useful book in Hindi. The book deals with principles, techniques and practices of managing forests for maintaining perennial flow of good quality water in streams and Rivers. Thorougly illustrated low cost edition is aimed at generating a debate on adding water production perspective in forest management.

We may be under an impression that nature is begging for mercy, but when nature will lose its patience and become merciless, nobody can save humankind.

It is quite heartening to know about the historic decisions of the Uttarakhand High court in Writ Petition No. 126 of 2014, Mohd Salim vs State of Uttarakhand and Others, have given verdict that while exercising the parens patrie jurisdiction, the Rivers Ganga and Yamuna, all their tributaries, streams, every natural water flowing with flow continuously or intermittently of these rivers, are declared as juristic/legal persons/living entities having the status of a legal person with all corresponding rights, duties and liabilities of a living person in order to preserve and conserve river Ganga and Yamuna.

In another Writ Petition No. 140 of 2015, Lalit Miglani vs State of Utttarkhand and Others the High Court has opined that Rivers and Lakes have intrinsic right not to be polluted. Polluting and damaging the rivers, forests, lakes, water bodies, air and glaciers will be legally equivalent to harming, hurting and causing injury to person. They have also stated that Rivers, Forests, Lakes, Water Bodies, Air, Glaciers and Springs have a right to exist, persist, maintain, sustain and regenerate their own vital ecology system. The rivers are not just water bodies. These are scientifically and biologically living. The rivers, forests, lakes, water bodies, air, glaciers, human life are unified and are indivisible whole. The integrity of the rivers is required to be maintained from Glaciers to Ocean.

The said order also emphasizes that Rivers are grasping for breath. We must recognize and bestow the Constitutional legal rights to the ‘Mother Earth’.The very existence of the rivers, forests, lakes, water bodies, air and glaciers is at stake due to global warming, climate change and pollution.

By invoking their parens patriae jurisdiction, the High Court declared the Glaciers including Gangotri & Yamunotri, rivers, streams, rivulets, lakes, air, meadows, dales, jungles, forests wetlands, grasslands, springs and waterfalls, legal entity/ legal person/juristic person/juridicial person/ moral person/artificial person having the status of a legal person, with all corresponding rights, duties and liabilities of a living person, in order to preserve and conserve them. They are also accorded the rights akin to fundamental rights/ legal rights.

Let us hope these remarkable decisions will help us bring some significant change in our attitude towards nature.
